Welcome to Shiftly Web Design. These Terms and Conditions (“Terms”) govern your access to and use of our website, products, and services. By engaging with Shiftly Web Design (“we,” “us,” “our”), you agree to be bound by these Terms. Please read them carefully before proceeding.

Shiftly Web Design specializes in AI-driven web design, development, branding, and digital marketing solutions. Each project’s scope, timeline, and deliverables will be outlined in a written agreement or project proposal.

• Providing accurate and complete information necessary to complete the project.

• Supplying all content (text, images, videos, etc.) unless otherwise agreed upon.

• Approving designs, revisions, and project milestones in a timely manner.
  Delays in providing feedback or materials may extend project timelines.

• A deposit (typically 50%) is required before work begins.

• The remaining balance is due upon completion or before website launch.

• All payments are non-refundable once work has commenced, due to the custom nature of our services.

• Late payments may result in suspension of services or delayed delivery.

Each project includes a set number of revisions as specified in the service agreement. Additional revisions or change requests beyond the agreed scope may incur extra fees.

• Upon full payment, ownership of the final website design and approved deliverables transfers to the client.

• Shiftly Web Design retains the right to display completed work in our portfolio, marketing materials, and social media for promotional purposes.

• Any AI-generated assets or tools used in development remain the intellectual property of Shiftly Web Design unless otherwise agreed.

Shiftly Web Design utilizes AI tools to enhance creativity, speed, and performance. While we strive for accuracy and originality, AI-generated elements may occasionally produce similar outputs used elsewhere. Clients are encouraged to review all content before publication to ensure alignment with their brand standards.

• Unless included in a specific package, hosting and maintenance services are billed separately.

• Clients are responsible for maintaining their domain and hosting credentials unless Shiftly Web Design manages them under contract.

• We are not liable for downtime, data loss, or performance issues caused by third-party hosting providers.

Shiftly Web Design is not liable for:

• Loss of data, revenue, or business resulting from website use or downtime.

• Third-party integrations, plugins, or software malfunctions.

• Any indirect, incidental, or consequential damages.

Our total liability for any claim will not exceed the total amount paid for the specific project in question.

Either party may terminate the project with written notice. If terminated by the client after work has begun, all completed work will remain the property of Shiftly Web Design until full payment is received.

Both parties agree to keep any confidential business, technical, or proprietary information private and not share it with outside parties without consent.

These Terms are governed by and construed in accordance with the laws of the State of Ohio, United States. Any disputes shall be resolved through binding arbitration or a court of competent jurisdiction in Ohio.

Shiftly Web Design reserves the right to modify these Terms at any time. Updates will be posted on our website, and continued use of our services constitutes acceptance of the revised Terms.
